General RulesPersonal & Business Boundaries
I am 21+. Please do not contact me unless you are 18 or older. If you are under 18, you must have verified parental consent before engaging with me. Any interaction with minors will be strictly business-related. I will not engage in personal friendships or conversations beyond what is necessary for commissions or business purposes.Right to Refuse Service
I reserve the right to refuse services, communication, or interactions with anyone at my own discretion, to the extent permitted by applicable law. While I aim to remain polite and professional, continued access to my time and work depends on maintaining respectful communication.Drama & Conduct
Please do not involve me in personal disputes, arguments, or unrelated drama. Matters that may concern me include violations of my Terms of Service or Rules, instances of impersonation of myself or others, individuals misrepresenting their age, and theft of my art, characters, or foals that are not backed by legitimate certificates.Blacklist Policy
I maintain a public blacklist. This is not intended for gossip, harassment, or public shaming. The blacklist exists solely to make it clear who is not permitted to purchase, own, or use my art, characters, horses, or bloodlines.Only names will be listed. Specific reasons will generally not be disclosed, as I do not support public shaming. In cases involving documented or confirmed violations, I reserve the right to provide limited information when reasonably necessary to explain or enforce a restriction. Please do not privately message me asking who did what. I will not privately shame or discuss other individuals, regardless of what they have done or are alleged to have done.Intellectual Property & OwnershipUnless otherwise agreed upon in writing, I retain all copyright, ownership, title, and intellectual property rights that I legally hold in every piece of artwork, design, base, character, complex coat pattern, and custom creation I produce.Purchasing artwork does not transfer copyright ownership.Upon receipt of full payment, the Buyer receives a non-exclusive, perpetual, worldwide license for personal use only, provided that the Buyer remains in compliance with these Terms of Service and applicable law.Personal Use License
The Buyer may use purchased artwork for personal characters, display the artwork online, and use it for roleplay, games, references, and personal collections.Purchased artwork may be resold for the same amount or less than the original purchase price unless the Buyer has added two or more additional pieces of artwork with reasonable effort and value.The Buyer may not use artwork for AI datasets or AI training, claim the artwork as their own, remove my signature, or copy, trace, recreate, or imitate my unique designs or complex markings.Sales RulesCredit & Usage
All artwork created by me must be credited to me wherever it is posted or displayed. Buyers may never claim my artwork as their own under any circumstances.Resale Rights
If you wish to sell art, characters, or horses purchased from me, you must contact me privately first. I reserve the Right of First Refusal (ROFR), meaning I have the option to buy the item back before it is publicly listed for sale.Pricing Policy
Horses or designs purchased from me may not be resold for a higher price than originally paid unless additional artwork has been legitimately added.Additional artwork must be of reasonable quality and effort. Using a large number of bases made by others solely to increase an item's value does not qualify.Horses bred by me, whether Non-High Value or High Value, will have different rules regarding their resale. Please refer to the applicable breeding and High Value rules below.Information Integrity
Any information provided about a horse, including lineage, stats, name, breed, or other recorded details, must remain accurate and may not be altered without my express permission.BasesNo Resale Rights
I do not consent to any of my bases being resold under any circumstances. I keep records of who purchases my bases and what they are purchased for.When you purchase a base, you are purchasing the right to use it for yourself and adopts only. You may not resell or transfer the base itself.Adopts & Personal Usage
All bases I create, whether Limited or not, may be used for adopts or personal use. You are NOT permitted to use my line's/bases for show entries.When using one of my bases for an adopt, ½ of the original amount you paid for the base is the maximum price you may sell each individual adopt for. Meaning if you paid $5 USD for a base/line your adopts may only reach $2.50 USD for adopts or other equivalent exchange.Signature
Do not, under any circumstances, remove my signature.You may move my signature to a different location when selling adopts, but my original signature must remain VISIBLE, intact, and clearly identifiable.Breeding/Foal RulesBreeding Limits
Horses bred by my horses have different breeding limits and requirements than horses that are not bred by me.To prevent overproduction, mares are allowed a maximum of 10 breedings, while stallions are allowed a maximum of 15 breedings.To solidify your breeding, you will be required to provide the following after purchasing a breeding from any of my horses:1. Stallion + Mare Interaction Post
Create a post featuring both the stallion and the mare together. This is simply to show that there was an interaction between the two parents before the foal is introduced. Please keep this interaction PG-13 — nothing explicit is required or allowed.2. Mare + Foal Introduction Post
Once the foal has been created, you will then need to make a post featuring the mare and her foal together as the foal's official "Intro" post.These posts are required to officially solidify and document the breeding.Foal Artwork Requirements
High Value foals bred by me, or foals produced using High Value studs or mares I own, will need to follow the following requirements:X1 foal image

X1 training imageThese must be completed before aging the horse to 3 years old.Non-High Value foals have a less strict set of requirements but must follow these requirements:X1 foal image
X1 yearling imageThese must be completed before aging the horse to 3 years old.Non-Lineage horses, or horses that I design and then sell with or without artwork, are not required to follow these foal artwork requirements.If using bases made by other artists or commissioning other artists for artwork rather than creating the artwork yourself, you are responsible for any additional costs associated with that artwork.Foals may NOT be taller than their sire or dam. Foals may also NOT be older than either of their parents.Branding & Ownership
Fairfield uses a traditional method of branding, with the mare's branding first followed by the stud's branding.If my mare is used with your stud, the branding is as follows:Fair/Your BrandIf your mare is used with my stud, the branding is as follows:Your Brand/FairHorses that I own, unless stated otherwise by the design creator, will retain my branding, "Fair," and must continue to have said branding EVEN IF they are sold, as I may include 5–10+ pieces of artwork with that horse.If a horse is JUST the original one-sided blank slate, whether that is the original purchased design or an original design reference, you do NOT need to keep "Fair" as its branding if you do not wish to.Free Covering
I reserve the right to one free covering from any foal produced by me.This means that for any foal produced by a stud or mare I own, I receive ONE free future covering to that horse.If you sell the horse, the buyer must be made aware of this requirement.Stud Availability
Only stallions listed as Available may be used for breeding. Please do not DM me requesting a covering from an unavailable stud.Breeding & Confirmation
Regarding the use of my horses for breeding, you may use any stud, mare, or broodmare I own that is available. High Value horses have an additional fee added to the breeding fee you are paying, while Non-High Value horses do not.When breeding with my horses, I will provide a maximum of 5 randomly generated, realistic coat options based on the parents' genetics. You may choose from those options.For Non-High Value offspring, you are free to design the foal yourself OR have me design it for an additional $5.For High Value offspring, you are NOT permitted to design the foal, but you will NOT be charged an additional fee for the design.Horses bred by me will receive a "birth certificate" stating whether they are High Value or Non-High Value, their date of breeding, their Sire & Dam names, their branding in the correct order, their name, gender, disciplines, estimated height, pheno and geno, along with the price of the foal when purchased.This certificate must be posted WITH the first initial post of the foal. This certificate serves as a record of the foal's legitimacy, and it is YOUR responsibility to keep track of it.Foals must retain a realistic coat based on their parents' provided geno.Registry & Updates
I do my best to maintain updated information regarding my horses, including registries, shows and placings, points, and foals produced.If a foal you own by one of my horses is not listed under their offspring, it is YOUR responsibility to DM me the foal's profile link through Instagram, DeviantArt, or ToyHouse, so long as it is a PERMANENT post.Should you sell said offspring, following the applicable offspring resale rules, you must DM me the buyer's name/username. It is YOUR responsibility to make sure the buyer has read and agreed to my TOS and understands the applicable rules.You will then be given a new copy of the certificate listing you as the original owner and the buyer as the current owner. You must also inform the buyer that, should THEY wish to sell the horse, they must follow these same rules.High Value Horse RulesThese horses are listed as High Value due to either being close to my heart, being offspring of close friends, or being offspring of horses who have passed away that I cherished.I reserve the right to change or add High Value horses at my discretion.High Value Horses* Fair "Trail Off Conversation"

High Value Horses will primarily produce fillies rather than colts. Colts produced from High Value Horses will only be permitted through additional payment, a High Value trade, leasing benefits, or close friends.Once again, whether foals produced by me are High Value or Non-High Value, I retain ONE free covering from them.If I believe someone frequently buys and resells horses quickly, I reserve the right to refuse them access to my High Value Horses.If a High Value offspring is being sold, the new buyer must gain my "OK" before the sale is completed to ensure there is no misrepresentation of my lines, High Value offspring, or horses.Foals produced directly from my High Value Horses may not be publicly overbred. They are limited to a maximum of 10 public foals.High Value Foal Resale
High Value foals are NOT permitted to be sold unless the following requirements have been completed:* Minimum of 5 placings of 3rd or better
* Minimum of 10 shows entered
* A bare minimum of 15–25+ pieces of artwork of the horse, whether your own artwork or artwork created by other artistsThese requirements are in place to prevent artists from buying my stock and reselling it for more with only a couple of additional pieces of artwork added.Non-High Value Foal Resale
Non-High Value horses and foals have more lenient resale requirements.Before a Non-High Value horse may be sold, it must have completed the required X1 yearling image, X1 placing of 3rd or better, and 3 overall entered shows.It must also have an additional 5–10 pieces of artwork of the horse before being sold.Right of First Refusal
I reserve the right to have first dibs regarding any and all sales of horses or foals produced through my breeding program.Before publicly listing an eligible offspring for sale, you must contact me first and give me the opportunity to purchase the horse.Design InspirationI DO NOT allow artists to take ANY sort of inspiration from my art or equine designs.If this is done, especially without credit, you will first be asked to re-make the design or take it down.If you refuse, I reserve the right to publicly identify the violation and permanently blacklist you from purchasing or using my designs, subject to applicable law.IF there are SUBSTANTIAL differences between the designs, then it will not count as "design inspiration," and you are fine.Tack RulesThese rules apply to both premade tack and custom tack created by Fairfield.No Resale Rights
Unlike adopts or custom horses, where resale rights may be included in the purchase price, tack does not come with resale rights.Tack is intended to be used as an accessory for your horse and does not gain or decrease in value in the same manner as a horse or character.Once you purchase tack, it belongs to you, but you may not sell, transfer, or give it to another person for free. It is sold specifically to you and may only be used by you.Violations & License RevocationMinor violations, such as failing to provide proper credit, may be handled through a Three-Strike Policy at my discretion.Serious violations, including but not limited to unauthorized resale, copyright infringement, tracing, design theft, or removal of signatures, may result in immediate termination of all licenses without warning.Upon termination, all licenses granted to the Buyer immediately end. No refunds will be issued for violations of these Terms, except where a refund is required by applicable law.If a license is terminated because of a violation, the Buyer must immediately stop using the affected artwork, characters, designs, or other licensed materials. Any ownership rights that were expressly transferred to the Buyer, if any, will be handled according to the applicable terms of the original transaction and applicable law.I reserve the right to issue DMCA takedown notices and pursue any other legal remedies available under applicable copyright law.A violation of these Terms may also result in permanent blacklisting from purchasing or using my artwork, designs, characters, horses, foals, or bloodlines.Governing LawThese Terms shall be governed by the laws of the State of Oregon, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.Any legal dispute arising from these Terms shall be resolved in the state or federal courts located in Oregon, unless another location is required by applicable law.If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in effect.
